COSMETIC PRODUCTS
The European Regulation 1223/2009 define cosmetics products as any substance or mixture intended to be placed in contact with the external parts of the human body (epidermis, hair system, nails, lips and external genital organs) or with the teeth and the mucous membranes of the oral cavity with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition or correcting body odours.
The above regulation apply to cosmetic products and explicitly exclude medicines, medical devices and biocides. In order to decide whether a product has to be considered cosmetic, it’s appropriate to make a specific evaluation, considering mainly product composition and all of its features, such as intended application site, function, intended use and presentation to final users.
Only cosmetic products complying with Regulation 1223/2009 can be freely marketed on the European area, upon being notified in CPNP portal.
